Intro

These Terms & Conditions ("Terms") govern your purchase and use of our DayZ server setup and configuration services ("Services") provided by BlackRainCoding ("we," "us," or "our").

By purchasing, booking, or using our Services, you agree to these Terms.

1. Services

We provide server setup, configuration, customization, troubleshooting, and related support services for DayZ servers and related game server environments.

Our Services may include:

• ▸server configuration
• ▸JSON and config file setup
• ▸installation assistance
• ▸customization of server settings
• ▸basic troubleshooting
• ▸support for agreed project scope

We do not provide any guarantee that a server setup will be compatible with all third-party tools, mods, hosts, game updates, or anti-cheat systems.

2. Scope of Work

The scope of each project is limited to what is agreed in writing before work begins, including through:

• ▸Discord messages
• ▸email
• ▸invoice notes
• ▸quote documents
• ▸project briefs

Any work outside the agreed scope may require additional charges.

If you request changes after approval of the scope, we may charge additional fees or decline the request.

3. Files Included With Services

As part of certain Services, we may provide files, configurations, JSON files, or other deliverables ("Deliverables").

Deliverables may include:

• ▸files created by us from scratch
• ▸files customized for your server setup
• ▸configuration files prepared for your use
• ▸other work product specifically listed in the project scope

Important limitation: We only include files in a setup if we have the right to do so. This means the files must be:

• ▸created by us,
• ▸independently developed by us,
• ▸licensed to us for redistribution, or
• ▸otherwise lawfully permitted to be included in the Service.

We do not knowingly include files that we do not have the right to distribute.

4. No Transfer of Third-Party Rights

Unless expressly stated in writing, our Services do not transfer ownership of any third-party intellectual property.

Any third-party content, including game assets, mod assets, code, or tools, remains the property of its respective owner.

If any Deliverable includes third-party material, your use of that material is subject to the applicable third-party license terms.

5. Customer Responsibilities

You are responsible for:

• ▸providing accurate project information
• ▸ensuring your server environment supports the requested setup
• ▸securing your own accounts, hosting, and credentials
• ▸complying with all applicable game, platform, hosting, and modding rules
• ▸reviewing any Deliverables before use

You agree not to use our Services or Deliverables in any unlawful way.

6. No Guarantee of Platform Approval

We do not guarantee that any setup, configuration, or Deliverable will be accepted, approved, or permitted by:

• ▸Bohemia Interactive
• ▸DayZ
• ▸your host
• ▸your mod platform
• ▸your server provider
• ▸Discord
• ▸any payment processor
• ▸any third-party service

You are responsible for making sure your intended use is allowed.

7. Payments

Payment terms are stated in the quote, invoice, checkout page, or direct written agreement.

Unless otherwise agreed:

• ▸payment is due in advance or as otherwise stated in the invoice
• ▸we may require a deposit before work begins
• ▸unpaid balances may delay delivery or support

All fees are stated in USD unless otherwise noted.

8. Refunds

Because our work is customized and service-based, refunds are handled as follows:

• ▸Completed work: non-refundable
• ▸Work started: partial refunds are not guaranteed
• ▸Completed Deliverables delivered to the customer: non-refundable
• ▸Cancelled projects before work begins: may be eligible for a refund at our discretion, minus processing fees if applicable

If you have a concern, contact us first and we will try to resolve it in good faith.

9. Delivery

Deliverables may be delivered by:

• ▸Discord message
• ▸email
• ▸file transfer link
• ▸download link
• ▸cloud storage
• ▸repository access
• ▸other agreed method

Delivery is considered complete when we send the Deliverable to the contact method you provided or make it available for download.

10. Revisions and Support

Unless otherwise agreed, the project includes only the revisions described in the quote or scope.

After final delivery:

• ▸support may be limited
• ▸additional edits may be billed separately
• ▸compatibility issues caused by third-party updates may not be included

11. Intellectual Property

All original work created by us remains our property until payment is complete, unless otherwise agreed in writing.

After full payment:

• ▸you receive a non-exclusive license to use the Deliverables for your own server or business use, as permitted by these Terms and any applicable third-party licenses
• ▸you do not receive ownership of our underlying methods, templates, code structure, or reusable know-how unless we expressly assign it in writing

We retain all rights not expressly granted to you.

12. License to Use Deliverables

Upon full payment, we grant you a limited, non-exclusive, non-transferable license to use the Deliverables for the agreed project purpose.

You may not:

• ▸resell the Deliverables unless we expressly permit it in writing
• ▸redistribute the Deliverables unless we expressly permit it in writing
• ▸sublicense the Deliverables unless we expressly permit it in writing
• ▸claim our work as your own if it was created by us

If a Deliverable contains third-party content, your rights are limited by that third-party license.

13. Customer Content and Materials

If you provide us with content, text, branding, files, images, or other materials, you represent and warrant that:

• ▸you own those materials or have permission to use them
• ▸they do not infringe any third-party rights
• ▸they may be used by us to perform the Services

You are responsible for any materials you ask us to install, configure, or include.

14. Compliance With Game and Platform Rules

You are responsible for ensuring that your use of any DayZ-related content, server setup, configuration, or modding materials complies with:

• ▸Bohemia Interactive's terms
• ▸DayZ EULA and modding rules
• ▸DayZ Tools terms
• ▸Steam rules
• ▸Discord rules
• ▸payment processor rules
• ▸host provider rules
• ▸any other applicable platform or law

We are not responsible for your independent use of the Deliverables after delivery.

15. No Illegal or Prohibited Use

You may not use our Services or Deliverables for:

• ▸illegal activity
• ▸fraud
• ▸infringement of copyright or other IP rights
• ▸harassment
• ▸hate speech
• ▸malware or harmful code
• ▸evading platform rules
• ▸any activity prohibited by law or by the applicable license terms

We may refuse, suspend, or terminate Services if we believe a request or use is unlawful or inappropriate.

16. Disclaimer

Our Services and Deliverables are provided "as is" to the extent permitted by law.

We do not guarantee:

• ▸uninterrupted service
• ▸compatibility with third-party tools
• ▸future compatibility after game updates
• ▸acceptance by any platform or service
• ▸specific revenue, player counts, or performance outcomes

17. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim related to the Services will not exceed the amount you paid us for the specific Service giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or server downtime.

18. Indemnification

You agree to indemnify and hold us harmless from claims, losses, damages, and expenses arising out of:

• ▸your misuse of the Deliverables
• ▸your violation of third-party rights
• ▸your violation of applicable rules, licenses, or laws

19. Termination

We may suspend or terminate Services at any time if:

• ▸you provide unlawful or infringing materials
• ▸you fail to pay
• ▸you abuse staff or support channels
• ▸your project is incompatible with our policies or applicable rules

If termination occurs, we may stop work immediately.

20. Changes to These Terms

We may update these Terms from time to time. The updated version will apply when posted or otherwise provided to you.

Continued use of our Services after an update means you accept the revised Terms.

21. Governing Law

These Terms are governed by the laws of the USA, without regard to conflict of law rules.

Any dispute arising under these Terms will be handled in the appropriate state or federal courts located in USA, unless otherwise required by law.
